THESE TERMS AND CONDITIONS ARE BINDING AND ENFORCEABLE AGAINST ALL PERSONS THAT ACCESS THE MOVINGHOME WEBSITE OR ANY PART THEREOF IN TERMS OF SECTION 11(3) OF THE ELECTRONIC COMMUNICATIONS AND TRANSACTIONS (ECT) ACT 25 OF 2002. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS YOU MUST LEAVE THE MovingHome WEBSITE IMMEDIATELY, AS FURTHER USE WILL AUTOMATICALLY BIND YOU TO THESE TERMS AND CONDITIONS.



Definitions and interpretation
  • “MovingHome” means MovingHome (Pty) Ltd, a Private Company registered in the Republic of South Africa with Registration Number 2007/015791/07.
  • “MovingHome website” means the MovingHome website located at www.movinghome.co.za and includes any part or element thereof;
  • “User” means any person who enters or uses the MovingHome website, notwithstanding the fact that such a person only visited the home page of the MovingHome website;
  • References herein to the singular include the plural and vice versa; and
  • Notwithstanding the fact that hyperlinks in these terms and conditions to copyright notices and legislation should be deemed part of these terms and conditions in terms of section 11 of the ECT Act, the fact that some or all of the hyperlinks may be non-operational, shall not play a role in determination of the validity and interpretation of these terms and conditions.




Detailed description of services

MovingHome offers you the smartest, simplest and quickest way to change your physical and postal address. By completing a once off 3-step process with the MovingHome call centre, or directly over the Internet, you are able to effortlessly update your address with hundreds of service providers, including banks, medical aids, life insurers, funeral policy providers, trade unions, clubs and memberships.



Delivery policy

Subject to receipt of payment and required documentation, requests will be processed within 7 working days. MovingHome’s maximum service level to other organisations/ merchants shall be three (3) email messages, telephone calls, and faxes. MovingHome reserves the right to record and store all telephone calls between MovingHome and users and between MovingHome and other organisations/ merchants. When you click to make a purchase with us legal obligations arise and your right to a refund of monies charged to your credit card or paid in any other way agreed by us, is subject to terms & conditions. You must not make any purchase through this site unless you understand and agree all our terms and conditions. Once payment is made for the purchase, it is accepted that you have read, understood and accepted the terms and conditions for such purchase. Refunds policy

MovingHome "AddressAddressChange" service involves capturing the users current contact details and forwarding these details onto those organisations selected by the user. MovingHome does not take responsibility for updating the user’s records at the selected organisations. This is the responsibility of the selected organisations. If the user has not received confirmation from the respective organisations within a reasonable period of time (normally 2 weeks), then the user should follow up with the organization in person, and notify MovingHome of the delay. The user will not be entitled to a refund from MovingHome based on their details not being updated by the respective organisations. Should you for any reason wish to cancel your purchase, other than because the organization has not updated your details, you will be liable for a 25% handling fee. You must advise us in writing of your cancellation and any such cancellation must be signed by the person who made the original purchase. MovingHome shall not under any circumstances be held liable for failure by any organization or merchant to update the user’s details or failure by the user to supply MovingHome with the user’s correct details.



Customer privacy policy

MovingHome shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/html/govdocs/legislation/2000/act2.pdf. This privacy policy applies to all the web pages related to this website. All the information gathered in the online forms on the website is used to personally identify users that subscribe to this service. The information will not be used for any purpose other that which is stated in the Terms & Conditions of use for this service. None of the information will be sold or made available to anyone outside of the terms of this agreement. The Site may collect certain information about your visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet; the date and time you access the Site; the pages that you access while at the Site and the Internet address of the Web site from which you linked directly to our site. Payment options accepted

Payment may be made via Visa, MasterCard, Diners or American Express credit cards.



Credit card acquiring and security

Credit card transactions will be acquired for MovingHome via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.



Customer details separate from card details

Customer details will be stored by MovingHome separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.



Merchant outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).



Responsibility

MovingHome takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.



Country of domicile

This website is governed by the laws of South Africa and MovingHome chooses as its domicilium citandi et executandi for all purposes under this agreement, 10 Hunter Street, Randburg, Johannesburg, South Africa whether in respect of court process, notice, or other documents or communication of whatsoever nature.



Variation

MovingHome may, in its sole discretion, change this agreement or any part thereof at any time without notice.

Software and equipment

It is the responsibility of the User to acquire and maintain, at his/her own expense, the computer hardware, software, lines and access accounts required to access the Internet and the MovingHome website and/or download content from this website.



Interception and communication

Subject to the provisions of the Regulation of Interception of Communications (RIC) Act 70 of 2002, the User agrees to MovingHome’ right to intercept, block, filter, read, delete, disclose and use all communications sent or posted by the User to the MovingHome website, its staff and employees; and The User agrees and acknowledges that the consent provided by the User satisfies the “writing” requirement as detailed in the ECT Act and the RIC Act.



Entire agreement and severability

These terms and conditions constitute the entire agreement between MovingHome and the User and shall take precedence over any disclaimers and/or legal notices attached to any communications and/or postings received by MovingHome from the User; Any failure by MovingHome to exercise or enforce any right or provision shall in no way constitute a waiver of such right or provision; and in the event that any term or condition detailed herein is found unenforceable or invalid for any reason, such term(s) or condition(s) shall be severable from the remaining terms and conditions. The remaining terms and conditions shall remain enforceable and applicable.



Assignment

The User shall not, without the prior and written consent of MovingHome, be allowed to assign, cede, or delegate its rights and / or obligations in terms of this License or the Terms and conditions, in whole or in part, to any third party.



Agreement in terms of Section 21 of the ECT Act

The User and MovingHome agree that:

  • The MovingHome website is hosted, controlled and operated from the Republic of South Africa and therefore the South African law enforced by the South African courts governs the use or inability to use the MovingHome website, its content, services and these terms and conditions.
  • MovingHome shall not be liable for costs incurred by Users to obtain professional advice relating to these terms and conditions.
